Here in Mexico, the most important first step, before making any kind of commitment to buy a property, is that the property records should be checked in the Public Registry of the state to verify that the property has a CLEAR LEGAL TITLE, and to obtain a legal certificate of no liens.
The second step that should be followed is that the records in the database should be reviewed to verify that the party that is offering the property for sale is indeed the LEGAL OWNER.
After this, the third step is to create a legally witnessed contract made by a state appointed lawyer, called a Notrario Publico. This is a contract that has state seals on it, and is enforceable in court.
The Mexican legal custom of the notario system, and official public lawyers who represent the state, dates back to ancient Roman times.
These are the beginning steps to initiate to buy a property.
If a bank trust is involved, or needs to be created, then the subsequent steps involve obtaining an authorization from the bank’s legal department, or the creation of a permit for a fidecomiso trust, issued by the federal government of Mexico.
